Immobiliare Magro S.r.l. (hereinafter, “Immobiliare Magro”) provides users of the Immobiliare Magro website (hereinafter, the “Site”, which can be visited at https://www.berninasuites.it) with the following information, in compliance with Article 13 of Regulation (EU) 2016/679 (or General Data Protection Regulation, hereinafter “G.D.P.R”) and subsequent national compliance legislation (hereinafter referred to, together with the G.D.P.R., as “Applicable Privacy Legislation”). During the consultation of the Site, information relating to users is collected, which constitutes personal data pursuant to the Applicable Privacy Regulations.

The information is provided exclusively for the Site mentioned above, and not for other sites accessible via links present on the same.

TYPES OF DATA PROCESSED

The data that are processed are specified below by Immobiliare Magro in the event that the user uses the Site. The user assumes responsibility for any personal data of third parties entered or published on the Site, and guarantees that he/she has the right to communicate or disseminate them - thus freeing Immobiliare Magro from any liability towards the aforementioned third parties.

Personal data acquired automatically in the event of a visit to the Site

  • Browsing data. Immobiliare Magro automatically collects data on the device (pc, tablet, mobile phone or other mobile device) and the connection used by the user, including, for example, the IP address, the date and time of access, information on hardware and software, information on events concerning the device, unique identifiers, crash data.
  • Data on the use of the Site. Immobiliare Magro collects information on the ways in which the user has used the Site, including, for example, the pages of the Site or other content displayed, searches performed, third-party applications (Google Maps, in all sections of the Site) present on the Site that are used by the user and links to other sites and applications on which the user has clicked.


Personal data provided directly by the user

  • Data provided via requests for information via email. If the user, to request information, explicitly and voluntarily sends an email to the Immobiliare Magro addresses indicated on the Site, or uses the form available under the heading “Fill in the form and send us your request - Do you want to book a stay in Valtellina?” present in the “Contacts” section, Immobiliare Magro acquires the email address and any personal data of the user (and/or third parties) included in the text of the electronic communication, as well as – for the form “Do you want to book a stay in Valtellina?” the email address, name, telephone number and any personal data of the user (and/or third parties) entered in the subject and message text.
  • Data provided to check the availability of the facility. If the user, to book a stay at the facility, through the section “Mountain vacation - Do you want to book a stay in Valtellina?” enters some personal data, Immobiliare Magro will acquire this data. The user is informed that as regards the booking of a stay at the facility, the latter will take place on the Booking Engine platform.

Personal data collected via cookies 
Immobiliare Magro uses cookies to collect data on the user's activity on the Site.

PURPOSE OF PROCESSING

Contribute to the functioning of the Site; provide the user with the services that Immobiliare Magro provides through the Site; protect the user's vital interests; comply with current legislation or pursue other needs of public interest
The user's data, in fact, are processed:

  • to operate, measure, improve and keep the Site and the services provided through it safe;
  • to prevent, detect and mitigate security breaches and potentially prohibited or illegal activities.

Pursue the legitimate interests of Immobiliare Magro in such a way that these interests do not prevail over the fundamental rights and freedoms of the user
The user's data, in fact, are processed:

  • to identify and resolve problems encountered by the user in using the Site (for example, blocked or non-functioning pages).

These treatments protect the interest of Immobiliare Magro in keeping the Site functioning and efficient. Furthermore, they do not infringe the fundamental rights and freedoms of the user, as they are predictable and widespread treatments on each site. Furthermore, these treatments also benefit the user, allowing the Site to continue to function.

METHODS OF PROCESSING

The user's personal data are processed with computer or telematic tools, exclusively for the purposes for which they were collected (see above), and stored for a specific period according to the criteria indicated in this privacy policy (see below). Personal data may be known and processed by the staff of Immobiliare Magro, duly trained on the precautions to be taken as required by the Applicable Privacy Regulations. 

DURATION OF TREATMENT 

The specific retention times of the user's personal data are documented in the register of processing activities of Immobiliare Magro (implemented pursuant to Article 30 of the GDPR). 
The user's personal data are retained (according to the criteria set out in recital 39 and Article 5, paragraph 1, letter e) of the GDPR) for a period necessary to ensure that the Site functions, and that Immobiliare Magro provides users with the services provided through the Site. This period, in any case, cannot exceed 10 years from collection. 
The user's personal data may be retained for periods longer than those just seen only in the if this is necessary for Immobiliare Magro to fulfill its legal obligations or to protect a right in court.
Upon expiry of these retention periods, the user's data is deleted or permanently anonymized.

DATA COMMUNICATION

Immobiliare Magro may communicate the personal data processed only to the subjects and for the sole purposes indicated below.
Fight against unlawful acts and security breaches

  • Immobiliare Magro may communicate the personal data of users to third parties who are responsible for preventing, detecting and mitigating potentially unlawful acts and security breaches.

Application of the law, legal proceedings and methods authorized by law

  • Immobiliare Magro may communicate the personal data of users to Judicial Authorities, Public Authorities or authorized third parties, in cases where the law provides for it. As well as, in general, in cases where it is necessary to fulfill legal obligations or verified requests relating to a criminal investigation or an alleged illegal activity, or to respond to claims made by others regarding the rights, property or safety of Immobiliare Magro, its employees or users.

RIGHTS OF INTERESTED PARTIES 

Only in the cases and with all the limits provided for by the articles. 15-22 G.D.P.R., the user has the right - at any time, free of charge and without any particular charges or formalities - to:

  • obtain confirmation of the fact that Immobiliare Magro is processing his/her personal data;
  • access his/her personal data, and know its origin, the purposes and purposes of processing, the retention period and information regarding the third parties to whom the personal data are communicated;
  • revoke his/her consent at any time, in the event that this constitutes the basis of the processing;
  • update or rectify his/her personal data collected by Immobiliare Magro, so that the latter are always exact and accurate;
  • exercise the so-called. right to be forgotten, or to have your personal data collected by Immobiliare Magro deleted from the databases and/or backup archives of Immobiliare Magro;
  • limit the processing of your personal data by Immobiliare Magro;
  • oppose the processing, for those personal data processed to pursue needs of public interest or legitimate interests of Immobiliare Magro;
  • be notified, in an appropriate time, of any corrections, cancellations or limitations of the processing ordered by Immobiliare Magro, as well as any revocations of such measures and the reasons behind the revocations.



The user can exercise these rights by means of a written request addressed without formalities to Immobiliare Magro, by sending a specific e-mail to the address info@berninasuites.it. 
Once the aforementioned e-mail has been received, Immobiliare Magro will satisfy the request within one month of receiving it. This deadline may be extended by two months – after prior notice to the user – taking into account the complexity and number of requests. Immobiliare Magro reminds the user that, if the response to his/her requests has not been satisfactory in his/her opinion, he/she may contact and lodge a complaint with the Personal Data Protection Authority (http://www.garanteprivacy.it/) in the ways provided for by the Applicable Privacy Legislation. 

CHANGES TO THE PRIVACY POLICY 

Immobiliare Magro reserves the right to make changes to this privacy policy at any time, giving notice to users on this page of the Site. 
Therefore, the user is asked to consult this page often, taking as reference the date of the last modification indicated at the bottom. Unless otherwise specified, in the event of a change, the previous privacy policy will continue to apply to personal data collected up to that point.
